Pool Drowning Accidents
RPWB attorneys have helped the families of drowning victims get compensation from the owners and operators of pools and waterparks.
The owners and operators of pools and waterparks have an obligation to the keep their pool-areas safe for people, especially children. Sadly, negligence is often at-play when a person drowns or nearly drowns.
Some common types of negligence include improper lifeguarding, insufficient fencing, a lack of warning signs, pool or slide defects, faulty wiring and unsafe drains.
In one recent case, a 9-year-old child nearly died when is day camp took a field trip to a North Carolina water park. The child slipped into a deep lap pool and wasn’t discovered by lifeguards for nearly seven minutes. He suffered severe brain damage and lost his ability to see and communicate. RPWB attorneys secured a confidential settlement that will enable him to receive quality care for the rest of his life.
How prevalent are drownings?
Drowning is the leading cause of unintentional death for children under the age of 5 and is the second leading cause of unintentional deaths for all children under 15, according to the Centers For Disease Control.
The commission’s latest data shows there were 346 reported fatal child drownings in pools and spas in 2014 involving children younger than 15, Of the drownings, 252 involved children younger than 5.
There are many more near-drownings, in which victims can also experience lifelong health effects, including brain damage and paralysis. It is estimated that an average of nearly 6,000 children are taken to the emergency room each year for non-fatal drowning incidents.
