The Settlement in this case has been appealed by the objectors. Until the Third Circuit Court of Appeals decides the appeal, the settlement is not final.
On Thursday, August 14th, 2008 the Court issued a Final Judgment granting final approval of the proposed settlement. On Thursday, August 21st an appeal was filed with the Third Circuit Court of Appeals by a group of objectors. The Court has issued a briefing schedule and briefing should be completed by March, 2010. Upon completion of the briefing, the parties will be notified by the Clerk of the Court of Appeals as to whether oral argument will be heard. The determination as to whether oral argument will be scheduled is within the sole discretion of the Court.
Until the appeal is resolved and the settlement is final, no distribution may be made to class members. While the appeals process is continuing, please keep us informed of any changes in your contact information, and check back here for further updates.
