In recent years, state governments and territories have begun exercising their rights under federal and local laws to recoup damages for loss of natural resources (Natural Resource Damage or NRD) caused by the release of hazardous substances into the environment. In addition to the costs of clean-up and remediation, NRD remedies include monetary compensation for damaged natural resources, which run the gamut from polluted surface and groundwater to the destruction of wildlife habitat. RPWB has partnered with the Law Offices of John K. Dema to provide quality representation in this complex but exciting area of law. The RPWB/Dema Group currently represents New Jersey, South Carolina, Mississippi, Puerto Rico and the U.S. Virgin Islands in their NRD programs and is pursuing a wide range of NRD claims involving volatile organic compounds, heavy metals, and petroleum products.

RPWB's environmental team also represents private parties injured as the result of contaminants released into the environment. In conjunction with local counsel, RPWB has filed some two hundred cases against an oil refinery for exposing workers to heavy metal catalysts; is pursuing claims for parties across the country who have developed life-threatening conditions from benzine exposure; and is litigating a class action involving the exposure of thousands of residents to bauxite and bauxite residue from a neighboring aluminum refinery. Recently, RPWB has also been focusing on the intrusion of TCE and benzine vapors into homes from underlying groundwater contamination. Environmental litigation is a challenging and evolving legal specialty. RPWB is proud to be in the forefront of this effort on a national scale.
