By order of the U.S. Bankruptcy Court for the Southern District of New York, settlement proceeds cannot be distributed until the multidistrict litigation reaches a conclusion. On January 13, 2010, the Fourth Circuit Court of Appeals granted review of certain legal issues in the multidistrict litigation and, accordingly, we cannot presently estimate when the U.S. District Court for the District of South Carolina will consider and approve a distribution of the proceeds. We do not anticipate that such proceeds can be distributed in 2010 given the current pace of the multidistrict litigation.
